Under Texas Family Code § 153.0071, courts may refer any suit affecting the parent-child relationship to mediation, including initial custody determinations, parenting time disputes, support proceedings, and post-decree modifications. Tarrant County courts routinely order mediation before scheduling contested family law trials, so arriving prepared matters.

How Texas Law Governs Family Law Mediation

Texas treats alternative dispute resolution as a matter of public policy. Texas Civil Practice and Remedies Code § 154.002 establishes the state’s commitment to peaceful resolution, and § 154.073 protects the confidentiality of mediation communications, meaning what’s said during sessions generally can’t be disclosed in later court proceedings.

A Mediated Settlement Agreement (MSA) is the written product of a successful mediation. To be enforceable, it must be in writing, signed by both parties and each party’s attorney if present, and include prominent non-revocation language. When those requirements are met, courts generally enter judgment on the MSA under Texas Family Code § 6.602.

In suits affecting the parent-child relationship under § 153.0071, a valid MSA is generally binding on both the parties and the court. A court may decline to enter judgment only in a narrow circumstance: where it finds that a party was a victim of family violence whose ability to make decisions was impaired and that the agreement isn’t in the child’s best interest. Texas Family Code § 6.602 also permits a party to object to a mediation referral where there is a history of family violence. Courts assess safety before proceeding in those circumstances.

Going to court hands a judge the final word on your parenting schedule, support amounts, and conservatorship rights. Mediation keeps those decisions with you and the other parent. Because sessions are confidential under Texas Civil Practice and Remedies Code § 154.073, what’s discussed generally can’t be used in later proceedings, which often encourages more candid negotiation.

Mediation is typically faster and less costly than contested litigation. Parents who reach their own agreements tend to comply with those terms more consistently because both parties helped shape them. When full agreement isn’t reached, the process still narrows the contested issues, often shortening any subsequent court hearing. Mediation isn’t the right path in every situation. Cases involving domestic violence or significant power imbalances may require court intervention, and we can advise you honestly about which approach fits your circumstances.

The Texas Family Law Mediation Process

Preparation determines how productive a mediation session can be. Before the session, we work with you to gather relevant financial documents and records, clarify what outcomes matter most, and identify where there may be room for compromise. Walking in without that foundation wastes time and often leads to impasse.

What Happens on the Day of Mediation

The parties typically meet in separate rooms with a neutral mediator moving between them. Direct face-to-face contact isn’t required. The mediator facilitates proposals and responses but doesn’t impose a decision.

Finalizing a Mediated Settlement Agreement

If the parties reach agreement, the MSA must be signed by everyone present that day, include the required non-revocation language, and be in writing to be enforceable. Signing the MSA isn’t the final step: a formal court order incorporating all MSA terms must still be drafted, reviewed, and approved by the judge. We handle that drafting and review to confirm the final order reflects what was agreed. If mediation ends at impasse, unresolved issues proceed to court, though any partial agreements on individual issues remain valid.
